Terms of Service

The Service

QNotify is a cloud-based queue management and notification platform. We provide tools for businesses to manage customer queues, send notifications (SMS, push, sound, voice), and offer table service via QR codes. The Service is provided on a subscription basis.

Accounts

To use QNotify, you must create an account with a valid email address. You are responsible for:

Maintaining the confidentiality of your login credentials

All activity that occurs under your account

Ensuring that your account information is accurate and current

You must be at least 18 years old or the age of majority in your jurisdiction.

Subscriptions & Payment

QNotify offers paid subscription plans billed monthly or annually. By subscribing:

Recurring billing

You authorize us to charge your payment method on a recurring basis.

Currency

Prices are in USD unless stated otherwise. Local options (e.g., GHS) may be available.

Upgrades

Take effect immediately with prorated billing for the remainder of the period.

Downgrades

Take effect at the end of your current billing period.

Cancellation & Refunds

You may cancel your subscription at any time from your billing settings.

You retain access until the end of your current billing period

No partial refunds for unused time on monthly plans

Annual plans may be eligible for a prorated refund within the first 14 days

We reserve the right to offer refunds at our discretion

Acceptable Use

You agree not to use the Service to:

Send unsolicited messages (spam) via SMS or push notifications

Collect personal data beyond what is necessary for queue management

Violate any applicable laws or regulations

Interfere with or disrupt the Service or its infrastructure

Attempt to access other users' accounts or data

Use the Service for any illegal, harmful, or fraudulent purpose

Customer Data

You retain ownership of all data you input into the Service ("Your Data"). We process it only to provide the Service.

We do not sell Your Data to third parties. Customer data from queue entries is minimal by design.

You are responsible for obtaining any necessary consent from your customers before collecting their data through QNotify.

Multi-Tenant Isolation

Each organization's data is logically isolated within our infrastructure. Your data is not accessible to other tenants. We maintain appropriate technical and organizational measures to ensure data separation.

SMS & Notifications

The Service sends SMS messages and push notifications on your behalf. You are responsible for:

Ensuring you have appropriate consent to contact your customers

Complying with applicable telecommunications regulations (including Ghana's NCA regulations, GDPR, and similar laws)

SMS delivery depends on third-party providers and mobile networks. We do not guarantee delivery.

Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice. Enterprise plans may include specific SLA guarantees as agreed in writing.

Limitation of Liability

To the maximum extent permitted by law:

The Service is provided "as is" without warranties of any kind

We are not liable for indirect, incidental, or consequential damages

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim

We are not responsible for losses caused by SMS delivery failures, push notification failures, or network issues

Termination

We may suspend or terminate your account if you violate these Terms. Upon termination:

Your access to the Service will cease immediately

We will retain Your Data for 30 days, after which it may be permanently deleted

You may request a data export before termination takes effect

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

Governing Law

These Terms are governed by the laws of Ghana. Any disputes shall be resolved in the courts of Accra, Ghana, unless otherwise agreed in writing for Enterprise customers.
